REGULATIONS OF THE HELENOW SETTLEMENT COMPLEX

Subject of the regulations

  1. The regulations apply to all persons staying on the premises of the Osada Helenów complex, in particular in each of the houses located in the complex.
  2. regulations define the rules for the provision of services, the responsibilities of the guests and Osada Helenów, and the rules for staying on the premises of the complex.
  3. The service provider is: JustComply JC sp. z o.o. sp.k. with its registered office at Helenów 58, 26-670 Pionki, NIP 7010489845, REGON: 361745358, KRS: 0000562252
  4. Confirmation of having read the terms and conditions is given at the time of booking, advance payment or payment of the entire amount due for the stay.

Bookings and payments

  1. The price per night is equal to the price per house.
  2. The guest is subject to the prices indicated in the price list at the time of booking.
  3. The booking is confirmed after the deposit has been paid. The deposit is 50% of the total price. The deposit must be paid within 24 hours of booking to the bank account specified during the booking process. Otherwise, the booking will be canceled. If the Guest cancels the booking at least 14 days before the planned arrival, the deposit is 100% refundable. If the Guest cancels the booking less than 14 days before the planned arrival, the deposit is non-refundable.
  4. The remaining amount, after paying the deposit, should be paid in full on the day before arrival – otherwise the reservation will be canceled.
  5. A deposit of 500 PLN is charged at the time of booking. The deposit is refunded within 72 hours of the guest’s check-out.
  6. We reserve the right to cancel unpaid reservations within 24 hours of booking without giving any reason.
  7. Early termination of a Guest’s stay at Osada Helenów does not entitle the Guest to a refund for the unused stay.
  8. Extending your stay at the Helenów Settlement is possible if there are any vacancies. Extensions are charged at the prices indicated in the price list at the time of the extension.
  9. Payments for reservations can be made by bank transfer to the bank account number provided in the reservation email or by online payment.

Invoices

  1. Invoices are issued for the stay. In order to receive a VAT invoice, please provide your tax identification number in the “MESSAGE” field when making your reservation.
  2. Invoices for the stay are sent by e-mail within 7 days from the end of the stay

Hotel night

  1. The houses in the Osada Helenów complex are rented for a minimum of two nights, except for the dates indicated in the special offers for: Easter, May Day, Corpus Christi, Summer Vacation (from June 20th to September 20th), November weekends, Christmas and New Year’s Eve.
  2. A hotel day lasts from 3 p.m. to 10 a.m. the following day. If you do not leave the house by 10 a.m. without prior confirmation of an extended stay, an additional fee of 50 PLN for each commenced hour of stay will be charged.
  3. Check-in between 3:00 p.m. and 7:00 p.m. is free of charge. An additional fee of 50 PLN may apply for check-in between 8:00 p.m. and 10:00 p.m.
  4. Early arrival before 3 p.m. or late departure after 10 a.m. must be arranged with the property manager (cost is 50 PLN per hour or part thereof).
  5. Maximum number of guests per house:
    • Skupienie – 4
    • Ceglasty – 4
    • Kaszmirowy- 4
    • Glade – 4 people

Accommodation

  1. On the day of arrival, guests receive a code for the door of the booked house and access to a telephone number to open the entrance gate.
  2. Each house has a remote control for the gate. If the remote control is lost or damaged, a fee of 100 PLN will be charged.
  3. After the stay and taking away the belongings of the guests, the remote control should be hung back on the hook by the entrance door or left there on the counter and the door closed.
  4. code for the entrance door expires after the hotel day, if it has not been extended.

Parking

  1. There is a free and unguarded parking lot on the premises of the Helenów Settlement.
  2. Parking is only allowed in the parking lot. It is forbidden to enter the parking lot through the wooden gate separating the houses from the parking lot. In case of violation of this prohibition by the Guests, a penalty in the amount of the deposit paid will be charged.

House

  1. Hazardous materials such as weapons, ammunition, flammable materials, explosives or irritants may not be stored in the house.
  2. For fire safety reasons, it is forbidden to use devices that are not part of the room equipment in the room, with the exception of chargers and power adapters for electronic equipment.
  3. Please consult the Facility Manager if you wish to change the arrangement of the household equipment.
  4. Guests are not allowed to take any of the complex’s equipment outside the Osada Helenów complex. Some of the equipment (e.g. buckwheat pillows) can be purchased. For more information, please contact us by email at kontakt@osadahelenow.pl.
  5. You are not allowed to wear muddy or wet shoes in the house. Please wear different shoes inside the house.
  6. Waste separation is mandatory in the house. The bins are located behind the sink in the kitchen.
  7. Non-registered persons are welcome to stay in the house from 7:00 a.m. to 10:00 p.m..
  8. If unregistered persons stay after 10 p.m., the registered person in the house agrees to accommodate them for a fee. Accommodation for each person will be charged according to the current price list available at www.osadahelenow.pl.
  9. For safety reasons, each time a guest leaves the house, they should turn off the lights, turn off the taps and close the windows and doors (by locking them).
  10. staff of the Helenów Settlement do not have the right to enter the rented house without the guest’s consent, let alone move the guest’s personal belongings. The right to enter the rented house is only granted in case of perceived safety risks for the Guests, cleaning or in case of non-compliance with these Terms and Conditions.
  11. The house is equipped with a free-standing cast iron stove. Only wood provided by Osada Helenów may be used to burn in the stove. The following is prohibited:
    • The Helenów Settlement is not liable for bodily injury, damage to health or other damage resulting from an accident caused by the incorrect use of the stove by the Guest and persons designated by him/her as staying with him/her in the house during the rental period.
    • placing objects on a hot stove
    • using and storing firelighters liquid
    • burning fuel not provided by the Helenów Settlement
    • causing smoke in the rooms of the house
  12. . There are fire extinguishers in a visible place in the house, which should be used in case of fire and the Facility Manager should be informed immediately. Unjustified use of the fire extinguisher will result in a deduction of 500 PLN from the deposit for cleaning and a new fire extinguisher.
  13. In the event of technical faults, the Guest is asked to report them to the Facility Manager as soon as possible, which will enable appropriate response and action.
  14. The guest is not authorized to make any repairs or make any expenditures or changes in the house and on its premises without the prior written consent of Osada Helenów. The guest is obliged to inform the property manager immediately about the necessity to make repairs or expenditures.

Other places in Osada Helenów

  1. Bonfires are only allowed in the designated area between houses 4 and 5, near the vegetable patch.
  2. Charcoal barbecues are strictly prohibited on the Helenów Settlement premises.
  3. The Ruska Bania building on the premises of the Helenów Settlement complex is subject to reservations and separate terms and conditions.

Guest Liability

  1. Children under 12 years of age should be under constant supervision of their legal guardians on the premises of the Osada Helenów complex. Legal guardians are financially liable for any damage caused by the children.
  2. The behavior of guests and people using the services of the facility should not disturb the peace of other guests. In case of violation of this rule, Osada Helenów may refuse to provide further services to the person concerned.
  3. Any damage to the property should be reported immediately to the Facility Manager, tel. +48 536 774 504.
  4. The guest bears full financial responsibility for any damage to or destruction of the equipment and technical devices of the Osada Helenów complex caused by him or her or by his or her visitors. In the event that a visitor sets off the fire alarm due to vandalism or failure to comply with the smoking ban, Osada Helenów will pursue its claims in court.

Responsibility of Osada Helenów

  1. Osada Helenów is only responsible for items left in the storage room. Osada Helenów reserves the right to refuse to accept valuable items, large sums of money, items that pose a safety risk and bulky items that cannot be placed in the deposit. In other cases related to the loss of or damage to items brought in by guests, the provisions of the Civil Code apply.
  2. Osada Helenów is not liable for damage to or loss of a car or other vehicle belonging to a Guest that has been parked in the unguarded parking lot of the facility. Osada Helenów is also not liable for items left in a car parked in the parking lot of the facility.

Items left behind

  1. Items left at Gruuna will be sent back at the Guest’s expense and to the address provided by them.
  2. In the absence of instructions, Osada Helenów will not store the left items.

Complaints

  1. Guests have the right to file a complaint if they notice any deficiencies in the quality of services provided. The complaint should be filed immediately after noticing the deficiencies.
  2. All complaints should be sent in writing to the following address: kontakt@osadahelenow.pl
  3. The complaint will be processed immediately after it is received by the Helenow Settlement. In case of any disputes, the Civil Code shall apply.

Commercial use

  1. The premises of the Helenow Settlement may not be used for commercial or advertising purposes without the consent of the site owners.

No smoking

All houses are non-smoking (including balconies and
areas around the houses). If you smoke in your house, you will be charged
2000 PLN, which includes cleaning and airing out the house as well as
additional washing and cleaning of equipment.

Additional provisions

  1. The Helenów Settlement also allows pets (stays in designated houses in accordance with the regulations and for an additional fee – limited number of places and only by prior reservation). Pets that have not been registered in advance and for which a reservation has not been confirmed in the dedicated houses will not be allowed on the premises.
  2. Guests staying with pets are obliged to remove any waste left by their pets in the house and throughout the entire Helenów Settlement.
  3. All damages to the property of the facility or the property of other guests caused by animals will be assessed by the management of the facility and the costs will be charged to the owners of the animals.
  4. Failure to inform the facility staff that you have an animal in your home will result in a fee of 500 PLN.
  5. The facility staff has the right to terminate the stay in the facility immediately without refunding the previously made payments to persons under the influence of alcohol and/or narcotics, behaving aggressively, violating the peace and/or property of other guests and not respecting the commonly used norms of social coexistence.
  6. The facility staff has the right to refuse accommodation and admission to Guests who show verbal or physical aggression towards the staff or other Guests. The deposit paid in advance is non-refundable.

Information on personal data

  1. The administrator of your personal data is JustComply JC sp. z o.o. sp.k. Helenów 58, 26-670 Pionki.
  2. data is processed on the basis of the contract for the provision of hotel services concluded between the Guest and Osada Helenów. The purpose of processing personal data is to provide hotel services or other similar services that are provided by Osada Helenów at the request of the Guest. In addition, the Guest’s personal data may be processed by video surveillance used in the facility. The purpose of video surveillance is to protect the safety of the Guest and other persons staying on the premises of Osada Helenów or in its vicinity.
  3. If the Guest provides personal data regarding preferences regarding their stay or services provided, the facility may process this personal data for the purpose of improving the quality of services provided by Osada Helenów or ensuring the comfort of the Guest or providing additional services to the Guest, including conducting Guest satisfaction surveys, solely in connection with the successive improvement of the services provided by the facility. The legal basis for the processing of personal data for the aforementioned purposes is the legitimate interest of Osada Helenów (Article 6(1)(f) of the GDPR).
  4. Osada Helenów informs that providing personal data to the extent necessary to identify the Guest is a contractual and statutory requirement (when documenting a sale made to the Guest with a VAT invoice). Failure to provide personal data prevents the conclusion of a contract with Osada Helenów, as well as the issuance of a VAT invoice.
  5. Osada Helenów informs that each Guest has the right to access, correct and update their personal data, as well as the right to transfer data, object to processing, restrict processing and delete personal data if there are legal grounds for doing so.
  6. Osada Helenów informs that the personal data of the Guest will be stored for the entire period of providing hotel services to the Guest, as well as the data will be stored for the period of limitation of possible claims, including tax and civil claims. However, personal data processed by video surveillance will be stored for a period of 14 days.
  7. The Guest’s personal data will not be subject to automated decision making, including profiling.
  8. . Osada Helenów informs that the Guest’s personal data may be disclosed only on the basis of applicable law.
  9. Osada Helenów informs about the right to lodge a complaint with the body supervising the processing of personal data, i.e. the Personal Data Protection Office in Warsaw, ul. Stawki 2.
